From 11 November 2025, the UK Immigration Rules introduced a major update. Part Suitability now replaces the old “Part 9 – General Grounds for Refusal”. 

This reform aims to create greater consistency in how the Home Office evaluates character, conduct and public interest factors across most visa categories. In this blog, we explain what the changes mean for applicants, sponsors and legal advisers.

What is Part Suitability?

Part Suitability provides a unified framework for deciding whether a person should be refused entry clearance (a visa), permission to stay or have their existing permission cancelled, based on various “suitability” grounds. 

Unlike the old system, the new rules distinguish clearly between mandatory and discretionary decisions:

• Mandatory refusal: applies where the applicant has been convicted of a criminal offence resulting in imprisonment of 12 months or more, regardless of when the conviction occurred.
• Discretionary refusal: applies to individuals with lesser convictions, non-custodial sentences or out-of-court disposals.

Key Grounds Under Part Suitability

Part Suitability covers several areas that can lead to refusal or cancellation. These include:

• Exclusion, deportation or travel ban: Permission must be refused or cancelled if the individual is subject to an exclusion or deportation order.
• Non-conductive conduct: Applications may be refused where a person’s conduct, character or associations make their presence in the UK undesirable.
• Criminality: Mandatory refusal or cancellation applies in cases involving serious criminal convictions. For example:
  • sentences of 12 months or more
  • repeat offending
  • offences that cause serious harm.
• Previous breach of immigration law: Overstaying or other immigration violations can impact new applications or lead to cancellation of existing permission.
• Debt to NHS or litigation costs: Outstanding NHS charges above the relevant threshold, or Home Office litigation debts, may be considered under suitability. 

Applications for leave that do not align with the Immigration Rules may be refused.

Why Does This Change Matter?

Part Suitability represents one of the most significant structural changes to the Immigration Rules in recent years. The biggest shift is in consistency. Under Part Suitability, most applicants are now assessed against a single, unified standard rather than route-specific tests. 

However, this shift also makes the system stricter, particularly for family and private-life routes that previously benefited from exemptions around overstaying or certain convictions.

As a result, applicants and sponsors need to be more vigilant in preparing their cases. 

Practical Tips for Applicants and Sponsors

• If you have any past criminal records, immigration breaches, unpaid NHS costs, don’t assume they don’t matter.
• Build a strong documentary record as a way of gathering evidence. Mitigating factors such as rehabilitation and compelling personal circumstances may help in discretionary cases.
• Full disclosure is key. Failing to tell the truth or under-reporting past problems could result in long-term reputational damage in future applications as well as risk refusal.

If you are a sportsperson, athlete or coach aiming to live and work in the UK, the International Sportsperson visa is your primary route. 

This specialist temporary visa is designed to attract top-level athletes and coaches to the UK and allows sports professionals with international recognition to work, reside and compete in the UK. 

Understand the Eligibility Criteria

To qualify for the International Sportsperson visa, you must:

• Be 16 years or older
• Have a valid Certificate of Sponsorship (CoS) from a UK-based sponsor with a valid sponsor licence.
• Obtain an endorsement from a recognised governing body in your sport, confirming your elite status and contribution to the sport in the UK.
• Meet the English language requirement (level A1 in speaking and listening) if applying for a visa longer than 12 months. 
• Demonstrate you can maintain and accommodate yourself in the UK, either through personal savings (£1,270 minimum for 28 days) or a sponsor guarantee. 

Securing a Governing Body Endorsement (GBE)

Each sport has its own governing body responsible for issuing endorsements. These bodies assess your achievements and potential contribution to the sport in the UK. Contact the relevant body early to understand their specific requirements and timelines.

2. Contact them to understand their application process.
3. Prepare your portfolio (international results, awards, references, etc). 
4. Submit your application following their guidelines.
5. Receive the endorsement letter or certificate which must be valid for submission with your visa application. 

Obtain a Certificate of Sponsorship (CoS)

Your UK sponsor, such as a sports club or organisation, must issue you a CoS. This document 

• Confirms your job offer
• Details your role, salary, and employment conditions 
• Is essential for your visa application

Gather Required Documents

Prepare the following documents for your application: 

• A valid passport or travel document.
• The Certificate of Sponsorship reference number.
• Proof of English language proficiency (if applicable).
• Evidence of maintenance funds (bank statements or sponsor’s guarantee).
• The endorsement letter from your sport’s governing body

Application Process

1. Apply online via the UK government website. 
2. Fill in personal info, job details and endorsement info. 
3. Upload documents: include endorsements, CoS, financial proof, English proficiency, passport. 
4. Pay fees: £319 (up to 12 months) or £769-£885 (over 12 months), plus Immigration Healthcare Surcharge (£1,035/year).
5. Review and submit, receive a reference number. 
6. Verify identity by biometric appointment or UK Immigration ID Check app. 

Immigration Skills Charge Exemption

Individuals applying via this route are now exempt from the UK’s Immigration Skills Charge (ISC).

The exemption includes not only elite sportspeople but also those in supporting roles such as coaches, instructors, and officials.

Await a Decision

Processing times vary:

• Outside the UK: Typically within 3 weeks.
• Inside the UK: Usually within 8 weeks.

You may be eligible to pay for a faster decision.

After Your Visa is Granted

With the International Sportsperson visa, you can: 

• Work for your sponsor in the specified role.
• Engage in voluntary work.
• Study, provided it doesn’t interfere with your sponsored role.
• Travel abroad and return to the UK.
• Bring eligible dependents (partner and children) with you.

The visa is initially valid for up to 3 years. After 5 years, you may be eligible to apply for Indefinite Leave to Remain (ILR), allowing permanent settlement in the UK.

Visa holders cannot claim public funds, start or run a business.

On 12 March 2025, the government laid new immigration rules in Parliament to reduce reliance on overseas recruitment in the care sector and prioritise care workers already in the UK who need new sponsorship.

As of 9 April 2025, additional requirements were introduced that affect care providers in England who wish to sponsor workers, particularly under occupation codes 6135 (Care Workers) and 6136 (Senior Care Workers). 

Who will be affected?

These additional requirements will apply to:

• Care workers or senior care workers applying for entry clearance from overseas.
• Care workers or senior workers applying from within the UK but who do not meet the following exceptions:
  • Already being sponsored under codes 6145 or 6146
  • In another visa route but already working in care and have been employed by their prospective sponsor for at least three months

Care providers intending to sponsor individuals applying for entry clearance or those who are in the UK but unable to meet either of the 2 requirements set above will have additional requirements in place.

From 9 April 2025, care providers looking to sponsor new workers from overseas must first attempt to recruit from within England, specifically from a pool of displaced care workers requiring new sponsorship.

If an applicant is seeking entry clearance from overseas or is in the UK but does not meet the specified exceptions, their prospective sponsor must provide evidence that they have actively tried to fill the role with candidates already in the UK. This includes efforts to recruit from the pool of displaced care workers who require new sponsorship.

Sponsors must obtain confirmation from their regional partnership verifying that they have met this requirement and that no suitable workers were found within the pool of displaced workers.

Additional evidence for switching visa routes

Those who are in the UK on a different visa route, currently working as a care worker and now looking to switch to the Care Worker route, must provide proof that they have been continuously employed by the care provider for at least three months before applying. Employers may be required to submit supporting documentation to verify this period of employment.

These changes to the Immigration Rules reflect a push from the Home Office to find new sponsorship for sponsored care workers who have been displaced because their sponsor has lost their licence; has not provided sufficient work; or has been identified by the relevant local authority as a person who requires new sponsorship. 

Employers in the care sector must adjust their recruitment practices to comply with these new rules. This may result in longer recruitment timelines as they seek local workers before hiring internationally.

Prospective care workers should ensure they understand these new requirements and check their eligibility before applying.

Becoming a British citizen grants you full rights in the UK, from voting in elections to working without restrictions and access to public services. If you were not born a British citizen or do not have British citizenship by descent, you will typically need to apply for naturalisation through the UK Home Office. The current fee for adult applications is £1,630. The fee for children under 18 is £1,214.

Do you meet the eligibility criteria?

Naturalisation is the most common route for foreign nationals seeking citizenship. Before you start your application, it’s essential to confirm that you meet the eligibility criteria:

• You must be over 18.
• You must have resided in the UK for at least 5 years (or 3 years if married to a British citizen). 
• You need to hold Indefinite Leave to Remain (ILR) or Settled Status for at least 12 months (unless you are applying as a spouse of a British citizen).
• Applicants must pass the Life in the UK Test, demonstrate sufficient English language proficiency and meet the good character requirement (including having a clear criminal record).

1. Prepare your documentation

• Gather all the necessary documents such as proof of residency (utility bills, bank statements, your passport or biometric residence permit and certificates for the Life in the UK Test and English language proficiency.

2. Tests and verification 

• Life in the UK Test: This exam assesses your understanding of British history, culture and laws. The test costs £50 and includes 24 multiple-choice questions. You will need a 75% score to pass. If you’ve already passed the test for ILR, you won’t need to retake it for citizenship.
• English Language Requirement: You must demonstrate your ability to communicate in English. You can meet the requirement with a degree taught or researched in English or by passing a Home Office-approved language test, unless you’re from exempt countries. 
• Good Character Requirement: Applicants over 10 must prove no criminal record, immigration fraud or financial issues. The Home Office will check your history including any convictions, bankruptcies or immigration violations.
  
• As part of your application, you’ll need to attend an appointment to provide biometric data (a photograph and fingerprints) to verify your identity. You will also need to provide two referees who should be professionals, know you personally and meet the Home Office’s specific criteria.

3. Citizenship ceremony 

• After approval, you will be invited to a citizenship ceremony. You must attend a citizenship ceremony within 3 months of receiving your invitation from the Home Office. 
• During the ceremony, you will officially pledge your commitment to the UK by making an oath of allegiance and a promise to uphold the country’s rights, freedoms and laws. 
• You will receive your British citizenship certificate along with a welcome pack.

As part of the UK’s initiatives to streamline and digitise border controls, the Electronic Travel Authorisation (ETA) system will become mandatory for all foreign visitors who do not require a visa to enter the UK from 25 February 2026. This system applies to all international visitors, except British and Irish nationals, requiring them to obtain an ETA or an eVisa before traveling.

What is an ETA?

An ETA is a digital travel permit linked to your passport, allowing you to visit the UK for up to six months.

With an ETA, you may visit the UK for tourism, business trips, visiting family/friends or short-term study (up to 6 months). You may also transit via UK airports, if you need to go through UK border control.

Introduced to strengthen border security and improve travel, an ETA does not guarantee entry – you must still present to a Border Force officer or use an ePassport gate. 

• Cost: £16
• Validity: 2 years or until your passport expires, whichever comes first
• Entry: Multiple visits allowed for stays of up to six months at a time 

The ETA scheme has been rolled out in phases. Full list of nationalities can be found in FAQ below.

This requirement applies to all travellers, including babies and children. If you get a new passport, you will need to get a new ETA. 

Important: If you need an ETA and do not have one, you may be denied boarding by the airline or refused entry upon arrival.

Who is exempt from ETA?

You do not need an ETA if:

• You hold a valid UK visa
• You have permission to live, work or study in the UK (including settled or pre-settled status or right of abode)
• You are transitioning through a UK airport and will not pass through border control (check with your airline if unsure)
• You are a British or Irish citizen
• You are travelling with a British overseas territories citizen passport 
• You live in Ireland and you are travelling from Ireland, Guernsey, Jersey or the Isle of Man
• You are a dual citizen with British or Irish nationality 

Note: If you hold a dual nationality, you should travel on a valid British passport (or Certificate of Entitlement), especially after 25 February 2026, to avoid being denied boarding or going through additional identity checks. 

Application Guidelines:

• Apply before travelling to the UK.
• Each traveller, including children, must apply separately.
• Your ETA is electronically linked to your passport, so you must use the same passport when entering the UK.
• If your passport expires, you must apply for a new ETA.

In the present day, modern slavery can be defined as the situation where individuals are exploited by others to gain personal or commercial benefits. This can involve manipulation, coercion, or even force, leading to a severe loss of freedom. While there is no typical profile for victims, this kind of exploitation tends to disproportionally affect the most vulnerable and socially excluded groups in society.

Types of modern day slavery

Modern day slavery consists of a number of ways to exploit and manipulate vulnerable people, here are some common scenarios:

• Debt bondage pertains to a situation where overseas workers, often hailing from impoverished backgrounds, generate substantial debts in order to cover recruitment fees, travel costs, and assorted expenses related to securing employment abroad. This scenario can give rise to a cyclical pattern of indebtedness, wherein workers find themselves trapped. Ultimately, this cycle can render them vulnerable to exploitation or coercive labour practices.
• Human trafficking involves the manipulation of workers’ vulnerabilities by traffickers, who employ deceptive tactics regarding the nature of the work they offer. Employing diverse methods to control and manipulate these workers, traffickers effectively curtail the individual’s ability to break free from the situation.
• The skilled worker sponsorship system in the UK, while designed to attract skilled labour, can inadvertently foster modern-day slavery and exploitation. Debt accumulation, tied visas, power imbalances, and inadequate oversight create conditions where workers, often vulnerable newcomers, are coerced into unfavourable terms. A lack of awareness and isolation further exacerbate their vulnerability, making them susceptible to mistreatment and abuse.

Employers legal and social responsibilities  

• Transparency in Supply Chains: Organisations with an annual turnover of £36 million or more are legally required to publish a slavery and human trafficking statement. This statement outlines the steps the organisation has taken to ensure that modern slavery is not taking place in their own business or their supply chains.

• The Modern Slavery Act of 2015 compels larger businesses to annually disclose the actions they’ve taken to prevent modern slavery in their operations and supply chains.
• Training and Awareness: Employers should provide training to employees and those in their supply chains on modern slavery awareness. This can help employees recognise the signs of exploitation and take appropriate action.
• Policies and Procedures: Employers should have clear and comprehensive policies and procedures in place to address modern slavery. These policies should outline the organisation’s commitment to preventing modern slavery, reporting mechanisms for suspicions or incidents, and consequences for violations.

What do you need to be aware of?

However, be aware of The Illegal Migration Bill – which passed into law recently – making it even harder to support vulnerable victims. The new law allows the government to legally detain and remove all people who unlawfully enter the UK.

Normally, any visit to the UK for less than 6 months is permitted on a visitor visa. But what if you want to be with a family member for longer? For visits over six months, overseas nationals who wish to join a family member in the UK must obtain a UK Family Visa.

The family member you are joining must be a British citizen; settled in the UK or holding Indefinite Leave to Remain; have been granted asylum in the UK; an individual in the UK with refugee status or have Humanitarian Protection status.

The overseas family member must apply to join their relatives in the UK. You can apply for a family visa to live with your:

• Spouse or partner
• Fiancee, fiance or intended civil partner
• Child
• Parent (if you are under 18 years old)
• Relative who will provide long term care for you

Family Visa – Spouses/Partners

Spouses and partners are given permission to stay in the UK for up to 2.5 years under the terms of the UK Family Visa. Once you have spent 5 years in the UK, you can apply to extend your stay and earn eligibility for indefinite leave to remain.

The maximum stay for fiancé(e)s is 6 months.

If you’re a partner of someone who is applying for a UK Family Visa, you must meet the following criteria:

• Both you and your partner must be at least 18 years old.
• Your connection must be sincere and ongoing.
• You both must want to live together in the UK long-term.
• Children who are dependent on you may also be listed on your application.
• You will be required to determine that both you and your partner can support yourselves financially, as well as any dependent children, without recourse to public funds. You will also need to meet the English language requirements.

Family Visa – Children

Children may apply independently to join a parent in the UK or as dependents on a parent’s application. However, they must meet the following criteria:

• They must be under 18 years old when they submit their application.
• They can’t be married, and they cannot have their own separate family unit.
• They cannot have an independent life.
• One of the child’s parents must have been granted entry clearance or leave to remain as a parent under a UK Family Visa (holding limited leave to enter or remain in the UK) or be in the process of making such an application.
• You will be required to show you can meet the financial requirements without the use of public funds. There is no English requirement for children.

Family Visa – Parents

You must meet the following criteria if you are applying for a UK Family Visa to join your child who is a resident of the UK:

• You must be at least 18 years old or above.
• Your child must be under 18 years old when you submit the application.
• You must have a child staying in the UK.
• If you are seeking indefinite leave to remain, your child must either be a British citizen, be a permanent resident, or have resided in the UK for at least 7 years prior to the application date.

You will need to show proof that you are the child’s only parent, the child generally lives with you, or alternatively, that you have joint parental responsibility for the child.
